This Privacy Policy explains how we collect, use, disclose, and safeguard your data when you visit our website, book a stay directly at our luxury self-catering lodge, or interact with us via email, telephone, or WhatsApp.

By using our services, booking accommodation, or accessing our property, you consent to the data practices described in this policy in compliance with the South African Protection of Personal Information Act, No. 4 of 2013 (POPIA).

1. Information We Collect

To provide you with an exclusive and secure experience, we collect information that falls into the following categories:

Identity and Contact Data: Full name, South African ID or international passport number, nationality, physical address, email address,  telephone number.
Booking and Financial Data: Dates of stay, number of guests, special requests, and financial details required to process EFT bank transfers or secure direct payments (including the refundable damage deposit).
Security and Location Data: * Vehicle registration numbers (collected at the farm gate entrance).
Closed-Circuit Television (CCTV) footage captured by our external security cameras for safety and perimeter monitoring.
Technical and Usage Data: IP address, browser type, and cookies collected when you visit our official website.

2. How We Collect Your Data

We collect personal information through the following touchpoints:

Directly from You: When you inquire about or book a stay through our website booking form, via email, or via WhatsApp, as well as when you complete guest check-in and indemnity sheets upon arrival.
Automated Technologies: Via external CCTV cameras located around the farm property for security purposes, and standard website cookies.

3. Policy Regarding Children (Under 18)

Under POPIA, individuals under the age of 18 are classified as children, and their personal data requires special, heightened protection. Naledi@53 is a family-friendly destination, but we strictly regulate how children’s data is processed:

No Direct Collection: We do not knowingly collect personal information directly from children. We do not allow individuals under the age of 18 to make inquiries or bookings.
Parental/Guardian Consent: Any information regarding a child (such as their name, age, or dietary requirements) necessary to facilitate a family booking must be provided exclusively by a competent person (a parent or legal guardian). By providing this information, you explicitly consent to our processing of the minor's data strictly for hospitality, booking, and safety purposes.
Gate Security & Registers: For safety and local regulatory compliance, the names of all minors staying on the farm must be listed on the main guest registry by the primary adult booker.
CCTV: External CCTV security cameras may inadvertently capture images of children in common outdoor areas (such as walkways or parking spaces). This data is processed strictly for the physical security of the children and the property, and is systematically overwritten.

4. Special Notice for Guests Aged 18 to 21

In South Africa, turning 18 means you are legally an adult and have the right to control your own personal information under POPIA. However, please take note of our lodge rules:

Booking Eligibility: While you are legally an adult at 18, our specific farm policy requires the primary, financially responsible person making the reservation to be at least 21 years old.
Data Control: If you are an 18-year-old guest staying as part of a group, we protect your information like any other adult. We will not share details about your stay or check-in records with third parties—including parents—without your explicit consent, unless there is a medical emergency or legal obligation.
Signing In: Upon arrival at the farm gate, all guests aged 18 and older must fill out their own details on the security register and sign the indemnity form in their own legal capacity.

5. How We Use Your Information

We process your personal information only for lawful purposes, including:

Fulfilling Bookings: Processing your reservation, collecting payments/deposits, and coordinating check-in/out times.
Guest Communication: Sending booking confirmations, directions to Farm 53 Blaauwbank (Brits), and load-shedding or gate curfew alerts (gate closed between 22:00 and 04:00).
Safety and Security: Utilizing night guards, armed response, and external CCTV to protect our guests, staff, wildlife, and the 72-hectare property.
Legal Compliance: Complying with South African hospitality, tax, and tourism laws.

6. Policy Regarding Links to Other Websites

Our official website may contain links to external websites that are not operated or controlled by Naledi@53 (for example, local tourism attractions in Brits, weather tracking services, or external map links).

No Control Over Third Parties: Please note that we have no control over the content, privacy policies, or practices of any third-party sites.
Review External Policies: This Privacy Policy applies solely to information collected by Naledi@53. Once you click on an external link and leave our website, we strongly advise you to read the privacy policy of every website you visit, as we cannot accept responsibility or liability for their respective privacy practices.

7. Disclosure of Personal Information

We do not sell, rent, or trade your personal information. We may share your information only under the following strict circumstances:

With Internal Staff: Trusted on-site managers and housekeeping staff who require basic details to prepare the lodge for your stay.
Security Personnel: Shared with our gate security, night guards, or armed response companies in the event of an emergency or check-in validation.

8. Law Enforcement and Regulatory Requests

We cooperate with government and law enforcement officials to enforce and comply with South African law. We may disclose your personal information, booking history, vehicle tracking data, or CCTV footage to the South African Police Service (SAPS), courts, or other authorized regulatory bodies if we believe it is reasonably necessary:

Legal Mandates: To satisfy any applicable law, regulation, legal process (such as a subpoena, summons, or warrant), or enforceable governmental request.
Emergency Situations: To protect the safety, rights, or property of Naledi@53, our guests, our staff, the public, or our wildlife in emergency situations where immediate harm is threatened.

Note: In accordance with POPIA, we will only disclose the specific, minimal amount of data required by law enforcement to fulfill their legitimate legal purpose.

We implement appropriate technical and organizational security measures to protect your data against unauthorized access, loss, or alteration. Physical guest registers are kept securely locked, and digital records are password-protected.

We retain your personal information only for as long as necessary to fulfill hospitality requirements or to comply with statutory South African financial/tax record-keeping obligations.

As a data subject in South Africa, you have the right to request access to the personal data we hold about you, request corrections to inaccurate information, object to data processing, or request data deletion (subject to legal retention requirements).
