BOOKING TERMS AND CONDITIONS

Welcome to the website of Naledi@53 Private Game Farm (“Naledi@53”, “we”, “us” or “our”).
These Terms and Conditions govern your access to and use of our website and, where applicable, enquiries, bookings, accommodation, facilities, activities and services provided by Naledi@53.
By accessing or using this website or making a reservation, you acknowledge that you have read and understood the terms applicable to your use of the website and your reservation.
Our Booking Terms, booking confirmation, applicable rate conditions, special-offer conditions and Privacy Policy should be read together with these Terms and Conditions.
Where a specific rate, package, promotion or third-party booking platform has conditions that apply specifically to a confirmed reservation, those conditions form part of that reservation, subject to applicable law.
Website Information
We take reasonable care to ensure that information appearing on our website is accurate and up to date.
However, photographs, descriptions, rates, facilities, wildlife information, activities, availability and other website content are provided for general information and may change from time to time.
Photographs are illustrative and may not always reflect the exact appearance, condition, furnishings, vegetation, wildlife or surroundings at the time of a guest's stay.
The presence, location or visibility of any particular wild animal cannot be guaranteed.
Bookings and Confirmation
All accommodation is subject to availability.
Submitting an enquiry or booking request does not necessarily constitute a confirmed reservation.
A reservation is confirmed once Naledi@53 or its authorised booking platform has issued the applicable booking confirmation and any payment required to secure the reservation has been successfully received or processed.
Guests are responsible for checking their booking confirmation and promptly notifying Naledi@53 of any error concerning dates, guest numbers, rates or other material booking details.
Rates and Payments
Rates are quoted in South African Rand unless otherwise stated.
Rates may vary according to dates, packages, length of stay, booking channels and special offers.
Rates, packages and special offers may be changed or withdrawn before a reservation is confirmed. Changes will not retrospectively alter a confirmed reservation except where permitted by law or agreed with the guest.
Where payment has been made by credit card:
the cardholder must be present at check-in;
the cardholder must present an acceptable ID or passport; and
the credit card used for the online payment must be presented at check-in.
Breakage Deposit
A refundable R3,000 breakage deposit applies to bookings where specified by Naledi@53 or the applicable booking conditions.
Subject to any legitimate deductions, the breakage deposit will be refunded three days after check-out.
Reasonable deductions may be made for loss, breakage, damage or other amounts properly chargeable to the guest in connection with the booking.
Payment of the breakage deposit does not limit responsibility for damage or loss exceeding the deposit where a guest is legally responsible for that damage or loss.
Check-In and Check-Out
Standard arrival and departure times are:
Check-in: 14:00–18:00
Check-out: 10:00–10:30
Guests should plan their arrival and departure within these times.
Guests expecting to arrive after 18:00 should contact Naledi@53 in advance to determine whether alternative arrangements can be made.
Early check-in or late check-out is not guaranteed and must be arranged with management in advance. Approved arrangements are subject to availability and may attract an additional charge where communicated and agreed beforehand.
Cancellation Policy
Unless different cancellation conditions are expressly stated in a special offer, promotional rate, quotation or booking confirmation, the following cancellation policy applies to bookings made directly with Naledi@53 Private Game Farm.
Standard Cancellation Schedule
Cancellation 22–30 days before arrival:
Forfeit 25% of the deposit.
Cancellation 15–21 days before arrival:
Forfeit 50% of the deposit.
Cancellation 8–14 days before arrival:
Forfeit 100% of the deposit.
Cancellation 0–7 days before arrival:
Forfeit 100% of the total booking amount.
For cancellations made more than 30 days before arrival, amounts paid will be refundable, subject to any card-processing or transaction costs that Naledi@53 is lawfully entitled to retain.
A cancellation is effective on the calendar date on which Naledi@53 receives the cancellation notice, calculated using South African local time.
No-Shows
A guest who fails to arrive for a confirmed reservation without prior cancellation will be regarded as a no-show and may forfeit 100% of the total booking amount, subject to applicable South African law.
Early Departure
Guests who voluntarily depart before their confirmed departure date are not automatically entitled to a refund for unused nights.
Any refund, credit or date amendment will be considered in accordance with the circumstances, applicable booking conditions and South African law.
Third-Party Booking Channels
Where a reservation is made through a third-party booking platform, the cancellation and payment conditions displayed and accepted for the specific rate at the time of booking will apply to that reservation.
Where those confirmed conditions differ from Naledi@53's standard direct-booking cancellation policy, the conditions attached to the third-party reservation will apply.
Where cancellation is submitted through a third-party booking platform, the cancellation date and time recorded by that platform will apply, subject to the conditions governing that reservation.
Consumer Protection
All cancellation charges will be applied subject to applicable South African law, including the Consumer Protection Act 68 of 2008, where applicable.
Nothing in this cancellation policy is intended to limit a consumer right or impose a cancellation charge that would be unlawful under applicable legislation.
Refunds and Card Transaction Fees
Where a refund is due, it will be processed in accordance with the applicable booking conditions and South African law.
Where funds paid by credit card must be reversed or refunded, Naledi@53 reserves the right not to refund card-processing or transaction costs actually incurred, to the extent permitted by applicable law.
Guest Numbers and Additional Guests
The villa accommodates a maximum of 12 guests, subject to the sleeping configuration applicable to the reservation.
Only guests included in the confirmed reservation are automatically authorised to stay at the property.
Additional guests or visitors require prior approval from management and may be subject to capacity restrictions, additional charges or other conditions.
Guests may not exceed the approved occupancy without prior approval from Naledi@53.
Exclusive Use
Naledi@53 is offered as an exclusive-use villa.
Exclusive use does not constitute unrestricted access to every area of the farm or permission to disregard safety, conservation, security or property rules.
Operational, staff, maintenance, security or other restricted areas may be excluded from guest access.
Parties, Functions and Events
A standard accommodation booking does not automatically authorise a party, wedding, function, retreat, corporate event, workshop, commercial activity or other organised gathering.
Guests wishing to arrange an event must obtain approval from management before booking or making arrangements.
Approved events may be subject to separate quotations, capacity limits, deposits, visitor arrangements, catering requirements, security requirements and event-specific conditions.
Smoking
Smoking is not permitted inside the house.
Guests must comply with designated smoking arrangements and take reasonable precautions to prevent fire, damage and littering.
Cigarettes, matches and other smoking materials must not be discarded in the veld, gardens or anywhere they could create a fire risk.
Pets
No pets are allowed at Naledi@53.
Self-Catering and Meals
Naledi@53 is primarily a self-catering establishment.
Meals and breakfast may be available by prior arrangement and at an additional cost unless expressly included in the confirmed booking, package or special offer.
Dietary requirements and meal arrangements should be discussed with management in advance.
Spa and Additional Experiences
Mobile spa treatments and selected experiences may be available by prior arrangement and subject to availability.
Guests wishing to arrange a spa package or other experience should contact management in advance.
Certain experiences may be supplied by independent third-party service providers and may be subject to separate prices, availability and conditions.
Wildlife and Natural Environment
Naledi@53 is situated within a natural game-farm environment.
Guests may encounter wildlife, snakes, reptiles, insects, spiders, vegetation, uneven terrain, water, changing weather conditions and other natural features or hazards.
Guests must not approach, chase, capture, feed, provoke, disturb or otherwise interfere with wildlife.
Guests must comply with reasonable safety, conservation and access instructions.
Parents and guardians are responsible for appropriately supervising children.
Game Farm Activities
Activities may include self-game drives, bush trails, wildlife viewing, birdwatching, catch-and-release fishing and other experiences advertised from time to time.
Guests participating in activities must act responsibly and comply with reasonable safety, conservation and access instructions.
Activities may be affected by weather, environmental conditions, wildlife considerations, maintenance or other operational requirements.
Swimming Pool and Facilities
Facilities may include a swimming pool, braai and entertainment facilities, pool table, bar area, patio, gardens and other amenities advertised by Naledi@53.
Facilities must be used responsibly and for their intended purposes.
Parents, guardians and responsible adults must appropriately supervise children and persons requiring assistance, particularly around the swimming pool, wildlife and outdoor areas.
Guest Conduct
Guests and visitors must respect the property, wildlife, staff, service providers and other persons lawfully present on the farm.
Guests may not:
intentionally damage or misuse property or facilities;
interfere with wildlife;
engage in unlawful activities;
create serious or unreasonable disturbances;
exceed approved guest or visitor numbers;
hold an unauthorised party, function or event;
enter restricted areas;
interfere with security or safety equipment; or
disregard reasonable health, safety, security, conservation or fire-prevention instructions.

Naledi@53 may take reasonable action in response to serious breaches, subject to applicable law.
Security and Access
Guests must comply with reasonable gate, access, vehicle-registration and security procedures communicated by Naledi@53.
Security measures may include CCTV, perimeter protection, security personnel, armed response and access controls.
Personal information collected for security purposes will be processed in accordance with our Privacy Policy and applicable South African law.
Personal Belongings
Guests and visitors are responsible for taking reasonable care of their personal belongings.
Loss, suspected theft, damage or security concerns should be reported to management promptly.
Naledi@53's responsibility for loss or damage remains subject to applicable South African law.
Damage to Property
Guests must take reasonable care of the villa, furnishings, equipment, facilities and surrounding property.
Material damage or breakage should be reported to management as soon as reasonably possible.
Guests may be responsible, to the extent permitted by law, for loss or damage caused by themselves or members of their booking party.
Amounts properly due may be deducted from the breakage deposit. Where loss or damage exceeds the deposit, Naledi@53 reserves its rights to recover any additional amount lawfully due.
Liability and Assumption of Risk
Guests acknowledge that staying at and exploring a private game farm involves risks associated with wildlife, natural terrain, outdoor activities and recreational facilities.
Guests must exercise reasonable care and comply with reasonable safety instructions.
Nothing in these Terms excludes, restricts or waives any liability, right or remedy where doing so would be prohibited by South African law.
In particular, these Terms must not be interpreted as excluding liability that may not lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable legislation.
Special Offers and Promotional Rates
Special offers and packages may contain additional conditions concerning minimum stays, booking periods, excluded dates, guest numbers, inclusions, exclusions, payment requirements or cancellation arrangements.
Where clearly disclosed before booking, the conditions applicable to the selected special offer or package form part of the reservation and apply together with these Terms.
Third-Party Services
Naledi@53 may provide information about third-party attractions, activities, transport providers, spa providers or other services.
Unless expressly stated otherwise, third-party businesses operate independently and their services are subject to their own availability, prices and conditions.
Website Links
The website may contain links to external websites or booking platforms.
Naledi@53 does not control third-party websites and is not responsible for their content, security, availability or privacy practices.
Intellectual Property
Unless otherwise indicated, content on the Naledi@53 website, including original text, branding, logos, photographs, graphics and other material, is owned by or licensed to Naledi@53 and protected by applicable intellectual-property law.
Website content may be viewed for personal and non-commercial purposes.
Content may not be copied, reproduced, republished, commercially exploited, distributed or materially modified without permission from the relevant rights holder, except where permitted by law.
Acceptable Website Use
Users may not use the website:
for unlawful or fraudulent purposes;
to introduce malicious software or harmful code;
to attempt unauthorised access to systems or data;
to interfere with website operation or security; or
in a manner that infringes another person's rights.
Privacy and Personal Information
Personal information collected through our website, enquiries, bookings, payments, guest registration and security procedures will be processed in accordance with applicable South African data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Children
Persons under 18 may not make a booking directly with Naledi@53.
Parents, guardians or other responsible adults are responsible for appropriately supervising children during their stay.
Electronic Communications
By submitting an enquiry or booking request, guests agree that Naledi@53 may communicate electronically where reasonably necessary to respond to the enquiry, administer the reservation or provide information relating to the stay.
Marketing communications will be handled in accordance with applicable law.
Website Availability
Naledi@53 aims to keep its website reasonably accessible but does not guarantee uninterrupted or error-free availability.
The website or online booking facilities may occasionally be unavailable due to maintenance, technical problems, security requirements or circumstances outside our reasonable control.
Force Majeure and Events Beyond Our Control
Naledi@53 will not be responsible for failure or delay caused by circumstances reasonably beyond its control, subject to rights and remedies that cannot lawfully be excluded.
Such circumstances may include severe weather, fire, flooding, natural disasters, interruption of essential utilities, government restrictions, civil disturbance, epidemics, pandemics or comparable events.
Where such circumstances materially affect a confirmed reservation, the booking will be dealt with in accordance with applicable law and the conditions applicable to that reservation.
Changes to These Terms
Naledi@53 may update these Terms and Conditions from time to time to reflect changes to its website, accommodation, services, operating practices or applicable legal requirements.
The latest version will be published on the website together with its effective or last-updated date.
Changes will not retrospectively remove rights that a consumer has under applicable law.
Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will, to the extent reasonably possible, be treated separately without affecting the validity or enforceability of the remaining provisions.
Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law, including any consumer rights concerning the appropriate forum or dispute-resolution process.
